Yama’s K15.5 million payout goes back to court

On May 18 PNGexposed revealed how Peter Yama and Zacchary Gelu had conspired to steal K15.5 million from the people of PNG.

We are pleased to report the matter is now back  before the courts

The National newspaper reports Department of Justice and Attorney-General secretary Dr Lawrence Kalinoe has applied for a Supreme Court reference on the matter.

Kalinoe, acting for the state through lawyer Peter Donigi, is seeking to establish the validity of the payout and whether due legal processes were followed.

The reference application is seeking answers from as far back as Nov 28, 2002, when a deed of settlement was reached between Yama and the solicitor-general, and leading up to a National Court order on April 14 for the money to be paid.

The state is arguing that the deed of settlement did not follow the basic principles of governance, highlighting parts 2, 3 and 6 of the Constitution dealing with the national legal system.

The State had also applied for a stay on the execution of the April 14 National Court decision.

The reference application was filed last month.

A three-judge bench comprising Chief Justice Sir Salamo Injia and justices Gibbs Salika and Bernard Sakora yesterday morning heard, and granted, an application by Yama seeking to be included in the special reference proceedings.

The matter was adjourned to next Monday for Yama’s lawyer, Ben Lomai, to submit a notice of objection to competency of the special reference sought by Kalinoe.

    Keep up with the expose’s on PNG political corruption. Reading above I note with interest now a battle battle between the corrupt who have stolen and the corrupt who have stolen and want to continue stealing and are using the country’s legal and judiciary system in a race to win. The real losers – the hard working families in PNG in urban and rural areas.

      PNG Political system seems above the Law that played so many delayed tactics to ones legal right.Our court system must not be politicized or else figures will sum up to trillions and that is not only in Peter Yama’s case.

      Can you see politics has involved in our court system? Only our laws can change this bad system and that law must come from a change of Government.Put your heads up and launch operation Raosim National Alliance (2012) and make amendments to our criminal laws.Why not the next Government introduce the Syria Law.If you steal,the hands must be chopped off.If you Kill, the killer must dai too.If you rape, your penis must be chopped off. Is it funny, right man.!!! Only tough laws can change leaders and their ways of leadership and not anyone’s rightful money that has been mingled around by politics within the system.You know what,Peter yama might get the money and challenge National Alliance so block all legal avenues and even notify all press commentators to publish shits. Nature knows your days are numbered by the Syria Law. Come 2012…………
